I have already giving a tenant a one week notice for payment, but it’s been a week! We live in the same house, and she has not said a word to me. I have given her many notices asking for the payment but she has not talked to me. To be honest, I’m actually scared of her because she has threaten me by saying “don’t mess with me or else”. I just want her to leave the house. Since she hasn’t paid for the rent and it’s been a week. No payment yet. What can I do??? I’m really scared!!!

I live in California, and we didn’t sign any contract
It’s a month to month rent. No Lease.
I just want her to leave so please help me write a decent notice because I’m so scared of her!! She hasn’t paid her rent so this is a good time for me to ask her to leave.

Dear Tenant,

I have already giving you a week to pay for your monthly rent, although I have not received the $500 cash + the late payment of $50.00 (with receipt of course). I’m sorry to say this but failure to give your payment in 3 days will result for you to move out of the house. If you don’t move out of the house by Febuary 17, 2012, I will have no choice but to call the sheriff to physically remove you. I will have all your belongings stored at the nearest public storage. I will then have to charge you for the amount that I have paid for storing your things.
