I was recently arrested without charges and spent 11 days in county jail before finally seeing a judge, who was unable to sort out why I was incarcerated until the 12th day, when I was released. During the execution of the search warrant on the building in which I was renting a room which resulted in my unlawful arrest, the key to my storage unit, as well as $900, my unemployment stubs, my check cashing receipts for the $900, my lottery tickets, and about $10 worth of stamps were seized. Despite the repeated requests of everyone who rented a room in that house, no search warrant was shown and I, and only I, was denied the ability to put on slippers or shoes before being marched through the splintered remains of the front door. I, having only recently recovered from pneumonia, was forced to sit barefoot in my sleepwear for nearly two hours on the front porch with the others, while they took our information and snapped photos of us with their camera phones.

About two weeks prior to the arrest, my girlfriend, while leaving the house, was struck three blocks away by a black ford expedition, which then fled, and had her car thrown into two cars parked on the side of the road. The officers who arrested her arrived at the scene with uncharacteristic alacrity, attempted three times to give her a breath test, failing each time due to her not understanding them as a result of an obvious concussion, stuck her in the back of the squad car within minutes of the accident, and had her car towed away and the skid marks left by the expedition scrubbed off of the pavement within 25 minutes of the accident occurring, well before any people from any of the insurance companies could arrive. My girlfriend had not had any alcohol for over 72 hours, yet she’s being charged with a DUI, and the police report states her blood alcohol level as “over .08,” which not only is suspiciously non-specific, but is impossible without some manner of tampering. They also took blood and urine samples from her, but did not provide that information, nor make reference to it, in the police report.

The reason I bring up my girlfriend’s incident is because the officer who led the team executing the search warrant, the one who arrested me, brought me to jail in a black expedition with brand new headlight covers and scratches with red paint (the color of my girlfriend’s car) on the passenger side of the front bumper.

I have not received a copy of the search warrant, nor any information as to precisely what was taken from me (I only know those things are missing from the property my mother recovered from my former room while I was in jail), nor do I have any idea how to get any of my property back. I am also aware that my constitutional rights were violated, as even the ADA who was present in court on the day I was released said so, and need to know what recourse I have against the county, city, and officer(s) involved. If anyone knows of a way I can help out my girlfriend as well, I would be very appreciative.
For clarification’s sake, I did not spend 11 days in court before seeing a judge, I spent 11 days in jail before seeing a judge. No charge was listed on the booking sheet, and no police report has been made available to me. Also, since apparently it is a concern for at least one person, the lottery tickets were purchased for me by my mother because I had been actively looking for employment for 2 years without any luck. Further, I do not live in some rural community, I live in San Jose, California, and police misconduct in this city has been rampant lately. Hopefully this clears up any confusion so I can receive a useful answer other than simply “Get a lawyer”. I am well aware I need one and am working on retaining one, unfortunately, having just recently been released, I don’t have one yet. I am requesting any specific knowledge anyone might have with a similar situation.

I know this is going to be long, but I really need help. When I was about 5 or 6 my birth certificate was put into a storage unit by my mothers controlling boyfriend and he never payed on it so it got thrown out I would assume. I have tried to order it online but I need to have a valid ID to order it. I do not have a valid ID because I need my birth certificate to get one. My mother cannot order it for me because her controlling boyfriend would not let her get her license renewed and ti expired 4 years ago. Her birth certificate was also in that storage unit. The only people who can get it for me are: a grandparent, which both mine are dead, a parent, but my mother doesn’t have valid ID and my biological father pretty much abandoned me at 5, or a spouse but since I do not have any ID I certainly cannot get married. I recently turned 18 and am trying to get my life straightened out. The only form of ID i currently have is my social security card. I was born in Georgia and currently live in Florida so I can’t just go to the hospital I was born in. Please help and don’t bash my mother for letting all of this happen.
I know this might be in the wrong section but in order to even apply for the financial aid i have to have proof of who i am. i was homeschooled and need to take the GED to put on the fasfa. i can’t take GED until i have id.
